Article 7: Refusal and Limitation of Carriage
7.1 Right to refuse carriage: We may refuse carriage of you
or your Baggage for reasons of safety or if, in the exercise of our reasonable
discretion, we determine that:
- such action is necessary for reasons of safety or security;
- such action is necessary in order to
comply with any applicable laws, regulations or orders of any state or
country to be flown from, into or over;
- your conduct, status, age or mental or
physical condition or the physical condition of your Baggage
is such:
(i) as to cause reasonable fear of harm, to
other Passengers or to our crew; or
(ii) that you may pose a hazard or risk to yourself, other persons or to
property;
- you have committed misconduct on a
previous flight and there is a reasonable likelihood that such conduct
may be repeated;
- you have not observed, or are likely to
fail to observe, our instructions;
- you have refused to submit to a security check;
- the applicable Tariff has
not been paid;
- the payment of your Tariff is fraudulent;
- you do not have the proper documents for
travel;
- the booking of our Seat has been done
fraudulently or unlawfully or has been purchased from a person not
authorized by us;
- the credit card by which you paid for the Tariff
has been reported lost or stolen;
- the Itinerary or booking or Electronic
Ticket is counterfeit or fraudulently obtained;
- the Itinerary has been altered by anyone
other than us or our authorized agent, or has been mutilated (in which
case we reserve the right to retain such documentation); and/or
- the person checking in or boarding
cannot prove that he is the person named as the Passenger on the Itinerary (we
reserve the right to retain such Itinerary in this circumstance).
7.2 Unaccompanied Child: Children below age 14 will not be
accepted for carriage unless they are accompanied by an adult. Children aged between
14-18 years may be accepted for carriage unaccompanied. Parents and guardians
must remain at the airport until the departure of the flight. Prevailing laws
of each country may differ in respect of the carriage of unaccompanied
children.
7.3 Passengers with reduced mobility/medical condition: Special Assistance: Acceptance for
carriage of incapacitated persons, persons with illness or other people
requiring special assistance is subject to prior arrangement with us.
Passengers with disabilities who have advised us of any special requirements
they may have at the time of booking of the Seat and been accepted by us,
shall not subsequently be refused carriage on the basis of such disability or
special requirements providing such disabilities meet the minimum terms and
conditions in relation to special assistance. Service fee will be collected
by our ground handling company as provided for in the schedule of tariffs
Limited Special Assistance
(a) The Carrier generally requires that Passenger(s) are able to travel
independently. We will not allow a person to travel without an accompanying passenger
unless the person can travel safely without assistance, supervision or both.
We do not have the systems, staff or facilities required to assume
responsibility for such assistance and supervision on the ground or in
flight.
(b) However, we do provide / arrange limited special assistance services
to accommodate customers who require a wheelchair to get to and from the
aircraft at a cost and to customers who wish to purchase two seats next to
each other when being accompanied by a person providing such assistance.
Carriage of Wheelchairs
Your personal fully collapsible manual wheelchair
or a pair of crutches, should
you require one, may be carried in the hold at no extra charge. We do not
provide this facility for an electric/motorized wheelchair. Carriage of
wheelchairs shall be subject to other requirements as we may implement from
time to time.
Aisle wheelchairs to negotiate / facilitate the aisle of the aircraft are
not available during embarking/disembarking or during flight. At certain
destinations the Carrier may require Passengers to use air stairs to embark and
or disembark when leaving the aircraft. If Passengers are unable to walk up
or down stairs, and to and from their seat unassisted by the Carrier,
they will not be permitted to travel on Viva Macau.
Upon reservation or at the airport, we will make every effort to arrange a
wheelchair from airport check-in to the aircraft steps or door. We
do not provide an escort to move the wheelchair from check-in to aircraft. We
will not be liable for loss, expense, breach of contract or other damage
should we, for any reason, be unable to extend such a service.
7.3.1 Travel with a companion: We may require
that you travel with a companion if:
- it is essential for safety; or
- the Passenger is unable to assist in his own evacuation from the aircraft; or
- the Passenger is unable to understand safety instructions.
7.3.2 Seating: We shall accommodate and assist all our Passengers
with specific requirements. Safety regulations stipulate that Passengers
with specific or additional needs should not be seated at emergency exits or
in cross aisles that form part of emergency exit routes.
We offer a pre-boarding service for our Passengers with specific
requirements. Our crew onboard shall use their best endeavor to allocate you
a seat that is most suitable to your needs.
7.4 Pregnant Passengers: It is the duty of pregnant Passengers
to advise us of the progress of their pregnancy at the point of booking of
Seat and at the check-in counter. Our carriage of pregnant Passengers
are subject to the following conditions:
- Pregnancy up to 27 weeks (inclusive): we will accept without a doctor's certificate.
- Pregnancy between 28 weeks to 35 weeks (inclusive): Passenger shall produce a doctor's certificate
confirming the number of weeks of pregnancy and that she is fit to
travel which certificate shall have validity of not more than seven
(7) days from the scheduled flight departure date.
- Pregnancy 36 weeks and above: we will refuse carriage.
7.5 Infants less than 8 days-old: We reserve the right not to
carry infants less than eight (8) days-old. We may in our absolute discretion
decide to carry such infants on our flights when such carriage is expressly
sanctioned in writing by a medical practitioner and when the parent of the
infant signs a limited liability statement.
7.6 Passengers requiring oxygen: Passengers requiring oxygen are not permitted for carriage.
